PC Affidavits and File Duplication

This service is designed to get initial information about your client’s case to you as fast as possible. If the county clerk’s office has your client’s file and you request it before 2pm, we will have it to you by the next business day (same day service available by phone call). We cannot be responsible if county doesn’t have the file available, however, it is usually available the next day and we are happy to check again 24 hours later. Files are almost always unavailable if requested within 48 hours of arrest or within a day of a court setting in which case the file is in the court house. If the case is not yet filed, we will get the PC affidavit to you. As soon as the case is filed (or if it has already been filed when you request it) we will get the bond, complaint and information sheets, and any other pertinent information in the file to your office as soon as we have access to it. We check once to twice a week to see if a case has been filed so you will always get your information within a couple days of the case being filed by the clerk. Felony cases are handled in the same way but have a $10 surcharge due to the slightly increased effort it takes to obtain them.

As soon as you send the information to us we will order the video from the County Attorney’s office. All you need to send us is the client’s name and the cause number. Our video turnaround times are the best in town. In most cases we get them less than 48 hours after the county has logged them in to the system and made them available for copy. However, we cannot be held responsible for a video we have ordered that the county does not provide to us. The following turnaround times are just estimates based on historical data. You will receive an update on your “My Case List” page each time the video has been requested.

  • APD cases - usually available within 3-4 weeks of arrest date
  • TCSO cases - usually available within 3-7 weeks of arrest date
  • DPS cases - usually available within 4-10 weeks of arrest date
  • UTPD, PPD - usually available within 4-10 weeks of arrest date
  • Manor, Bee Caves, Mustang Ridge et al. - anywhere from 4 weeks to 4 months from arrest date

We have no control as to when a video arrives in Travis County from another agency. We can only order them, order them again and wait. All order dates will be logged in and accessible on your “My Case List” in case you need to explain to a judge or a client as to why they have not arrived yet. When you send the name and cause number of your client we will order the video, send follow up orders if it hasn’t arrived and copy the video on a DVD and deliver/mail it to your office. If there are any issues with the functionality of the DVD we are happy to review it and recopy it if necessary until you have the evidence you need on DVD. If you believe there to be more on the tape then we have provided you, or if there is an audio video issue we will check the original and make an additional copy for you if it can be improved at no charge to you. The $20 is per original tape, not per case. Most tapes run between 45 minutes and 1 hour 15 minutes. Tapes running longer than 1 and a half hours will be charged as two tapes.

Must order 12 business days before Pre Trial Setting. The best way to get your client’s discovery packet before the pretrial is to order them the day your client retains you as his/her attorney. We can’t order the offense reports until the case is filed and then there is a two week turnaround time from the day we order them. We are confident that if you order this service 12 business days before the first pretrial setting you will have your offense reports ahead of that date. However, we do not want to give off the impression that we can get offense reports/Discovery packets on short notice. Having the file, Discovery packet and video before your pre-trial date can afford you the luxury of skipping the pretrial settings and putting your client straight on the Jury docket if desired, speeding up your practice’s turnaround time per case allowing you to take more cases per year. Our studies also show that this increases client retention and referrals because they feel their attorney is being proactive with their case instead of hearing excuses as to why certain documents aren’t available and their case is delayed. Even though your reasons for delay may be legitimate, these clients can incorrectly believe to think not enough is being done on their case and switch attorneys. We believe our real time status update system allows communication to improve between your office and your client which inevitably increases retention and future referrals.

Running For The Law is happy to save you and your office the trouble of standing around waiting for a clerk to stamp your motions. Our same day turnaround times will also help you keep from allowing “not-yet-filed motions” pile up in the office causing your cases to slow down. If you leave three copies of each motion signed and ready to go in the plastic Running For The Law motion box at the front of your office, one of our runners will pick them up, file them at the county clerk’s office and county attorney’s and return them to you. There will be a per case filing fee and a $5.00 per pickup pickup fee giving your office the incentive to group your cases together before calling our runner over to pick them up. Each case includes five motions with a surcharge being issued when there are more than five motions.

We are happy to file your subpoenas for ALR cases and respect their time sensitivity. Please call us to let us know you have one for us to deliver and what the deadline is. We will deliver the subpoena to SOAH and return the necessary documents to your office.

Criminal history can be a critical factor when defending a criminal case or representing someone involved in a civil case. Certified and uncertified files are available in most Texas counties and we at Running For The Law will do what it takes to get you every file you need. The information available varies greatly individual to individual so we will always speak with you to discuss what is available and the price to obtain it so you only pay for what you want/need. Uncertified copies are also available and carry a lower administrative cost.

Background and criminal history checks can be done on your client or on anyone involved in your client’s case. Our lawyers seem to be very pleased when we can pull old case files, police reports and video evidence from past cases. These can be very tedious to order and follow up with and we can do it at an affordable rate. Need case reports from other counties? We can usually do that as well. These types of requests are usually case specific and the amount of information varies case by case. Unlike many businesses today we are always available by phone to discuss what we can and can’t do for you so you have a clear understanding of what is available and what it will cost to obtain. Please include correct spelling of the subject’s name and birthdate in order to recieve accurate records.

In an experiment done with an Austin attorney, Running For The Law was asked to copy the PC Affadavit, copy the file, order and copy the DWI video, and obtain the discovery packet/offense reports in two cases. Both requests for all tasks were received from the defense attorney’s office on January 29, 2010. Client 1 was arrested on December 27, 2009 which gave us the advantage of the case already being filed which resulted in a copy of everything in the client’s file being delivered to the attorney’s office the same day as the request. Client 1 was arrested by an APD officer and his video was available the first time we ordered it and was delivered February 3rd. The discovery packet came available two weeks after the 29th and was scanned and emailed to the attorney’s office 2/11/10. This case had an announcement setting March 11th so the attorney was able to put his client on the Jury docket immediately after the announcement setting, speeding up the process of this case significantly. Client 2 had been arrested a little later and as a result her case was not yet filed by the county. The PC’s come available approximately 48 hours after arrest and that was delivered to the defense attorney on the same day that the request was made. Her case was filed by the county on February 11th and the rest of the file (complaint/information/bond etc.) were all sent to the attorney’s office the next day. Client 2’s arrest was also by an APD officer and thus her video was available the same day as client 1’s. The discovery packet came available 12 business days after the case was filed and the attorney had all the paperwork he needed for this case on March 2nd, two days before the announcement setting of March 4th. These results allowed the attorney to move this case through the courts significantly faster than comparable cases. These results are typical and will hold true for 90-95% of APD arrests. In non APD arrests the video could take 4-8 weeks longer but often come available in a similar window of time. The full kit will be available before the first pretrial setting in about 70% of non-APD cases.

Case Study 2

In a recent civil suit "Joe Client" was hit and injured by "Johnny Drunkdriver". The attorney representing Joe Client’s civil claim against Johnny Drunkdriver called Running For The Law to get a copy of the DWI video filmed by an APD officer of Johnny Drunkdriver. Unfortunately, due to circumstances beyond our control, that video was not available. However, we were able to pull all the case reports involved with the case. We also found through our research that Johnny Drunkdriver had a DWI arrest from 2003 as well. RFTL was able to deliver certified files and police reports from Johnny Drunkdriver’s previous DWI arrest as well as the DWI video from the 2003 arrest. We were also able to deliver a criminal history report and driver record report on Johnny Drunk Driver. The attorney representing Joe Client was thrilled to have all this information to help build his case against Johnny Drunkdriver.
